As ratified in TIP-14, Magicswap is a decentralized, open source product that is governed by Treasure DAO via gMAGIC holders and its AMM Council.

Key mechanisms, including token listing (ERC-20 pools only), fees and liquidity that empower the community and facilitate growth in the ecosystem, are determined through governance. As of TIP-40, NFT pools (NFT to NFT and NFT to ERC-20) are authorized to be created by the Treasure core contributing team without the need for future votes to the DAO.
